Terms of Service

These Terms of Service ("Terms") govern access to and use of the OneBeauty Concierge application and related services (the "Service"), provided by ONEBEAUTY SPACE INC. ("OneBeauty," "we," "us," or "our"). By accessing or using the Service, you ("you" or "Business Client") agree to these Terms. If you do not agree, do not use the Service.

1. The Service

OneBeauty Concierge is a messaging and appointment-booking assistant that helps beauty and wellness businesses communicate with their customers across channels such as WhatsApp, Instagram, Messenger, and web chat. The Service uses automated processing, including artificial intelligence, to help understand messages and generate responses for booking and customer-support purposes. The Service is a task-specific assistant for these business communication and booking use cases and is not a general-purpose AI assistant.

2. Eligibility and accounts

You must be a business, or an authorized representative of a business, and at least 18 years old, to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity under your account.

3. Connected messaging platforms

To use the Service, you may connect third-party messaging accounts (for example, a WhatsApp Business Account or Instagram Business Account). Your use of those platforms is also governed by the applicable Meta and WhatsApp terms and policies, including the WhatsApp Business Messaging Policy. You are responsible for complying with those terms, and we may suspend features if a platform requires it.

4. Your responsibilities

You agree that you will:

  • Obtain all consents and provide all notices required by applicable law before using the Service to message your End Customers;
  • Maintain your own privacy notice to your End Customers;
  • Use the Service only for lawful business communication and booking purposes;
  • Not send spam, unsolicited, deceptive, harassing, or unlawful messages;
  • Not use the Service to collect or transmit sensitive data in violation of law or platform policy;
  • Comply with all applicable laws, including telemarketing, messaging, consumer-protection, and data-protection laws.

5. Prohibited use

You may not (a) reverse engineer, interfere with, or disrupt the Service; (b) attempt to gain unauthorized access to the Service or related systems; (c) use the Service to violate the rights of others or any applicable law or platform policy; or (d) misrepresent your identity or your authority to act for a business.

6. Fees

Fees for the Service, if any, are as agreed between you and OneBeauty. Where third-party platforms (such as Meta) bill you directly for messaging usage, those charges are your responsibility and are governed by your relationship with that platform.

7. Intellectual property

The Service, including its software, design, and content (excluding your data and your End Customers' data), is owned by OneBeauty or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. You retain ownership of your data.

8. Automated responses; no professional advice

Responses generated by the Service are automated and may contain errors. They are provided for scheduling and general business communication only and do not constitute medical, cosmetic, professional, or other specialized advice. You are responsible for reviewing and, where appropriate, supervising communications sent through the Service.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, OneBeauty will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim, or one hundred U.S. dollars (US$100) if you paid nothing.

11. Indemnification

You agree to indemnify and hold harmless OneBeauty and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content or messages, or your violation of these Terms or applicable law or platform policy.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or applicable platform policies, or as needed to comply with law. Upon termination, we will delete or de-identify your data as described in our Privacy Policy and Data Deletion page, subject to legal retention requirements.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in Kings County, New York will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
